Where can a Vietnamese national apply for a US visa?


Applications for US immigrant and non-immigrant visas may be filed at the US Consulate at the US Embassy in Ho Chi Minh City, Vietnam.  Visa applications or inquires must be made during the hours of operation the Consular Section has established for inquires/applications regarding that particular visa category. A complete schedule of the hours of operation may be found on the
consular website.

Can US citizens residing in Vietnam file a petition to sponsor their Vietnamese fiancee or spouse in Vietnam?

The initial petition to sponsor a foreign fiancee or spouse must be filed with the United States Citizen and Immmigration Office (USCIS) with jurisdiction over the area of residence of the US petitioner.  US citizens who are able to establish that Vietnam is their place of residence and who have resided continuously in Vietnam for at least one year may file their petition with the USCIS office in Ho Chi Minh City, Vietnam.  Persons eligible to file their petition with the USCIS office in Vietnam may benefit from a faster processing time.

What kind of supporting evidence is required to apply for a K-1 fiancee or K-3 marriage visa?

Applicants for K-1 Fiancee and K-3 Marriage visas will need to submit evidence of their relationship to the US citizen visa petitioner.  In the past airplane tickets and visas utilized by the couple to travel to meet one another, photographs of the couple, e-mails, records of phone calls and related documents have generally been considered sufficient documentation of relationships. However a visa fraud ring was recently uncovered in which elaborate document trails were created to make fraudulent relationships between American citizens and Vietnamese citizens appear genuine. As the US Embassy in Vietnam has reportedly not found a way of distinguishing certain genuine relationships from elaborate scams, it has been reported that visas are only being issued in instances of a well-documented long term relationship and/or cases in which the couple has children.  

May US citizen petitioners attend the interview with their Vietnamese fiancee or relative?  

The US Consulate in Ho Chi Minh does not allow US citizen petitioners to accompany their Vietnamese fiancee or relative to the interview. 

How long does it typically take to process a K-1 Fiancee Visa Application or a K-3 Marriage Visa application at the US Consulate in Vietnam?

The US Consulate in Vietnam typically schedules interview dates three months from the date on which the packet is received from a USCIS processing center.  Visas are generally available for applicants to pick up at the Consulate on the day after their interview.

Processing time for the K visa packet varies depending on the USCIS Service Center and backlog.  Typical processing times for USCIS Centers in the US range from approximately 4-6 months.  Processing time for USCIS Service Centers abroad is generally less than in the US, however, petitions must be submitted to the service center with jurisdiction over the area in which the petitioner resides.
